In accordance with the provisions of the General Data Protection Regulation, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights, approved on 5 December 2018 (LOPDyGDD), CCPC, informs you that it fully complies with the current legislation on the protection of personal data, and with the confidentiality commitments inherent to its activity.
CCPC informs you of the existence of an information processing system for the purposes of management, communication and information with its clients.
This website is managed by Ms. RAQUEL MARÍA MILLÁN SONK, in her capacity as data processing manager, with ID number 788.575.03-W and address for the purposes of this Policy at: Cno. La Medida nº20, C.P. 38613, Vilaflor, Province of Santa Cruz de Tenerife, who assumes responsibility for the adoption of technical and organisational security measures to protect the confidentiality and integrity of the information, in accordance with the aforementioned regulations.
- SECURITY MEASURES AND LEVELS OF SECURITY:
CCPC has adopted the necessary measures to guarantee the security of the information collected from its clients, as required by art. 32 of the RGPD, according to the nature of the personal data processed and the circumstances of the processing, in order to avoid, as far as possible, its alteration, loss, processing or unauthorised access, thereby guaranteeing the confidentiality, integrity and availability of the same.
3.DATA COLLECTION:
The provision of the services offered by CCPC and subject to these conditions, requires the User to collect certain essential data for this purpose, which will be requested personally through forms sent by e-mail or through the web page itself. At the time of collecting the data, the User will be duly informed of the rights to which he/she is entitled.
In order to ensure that the information contained in our processing system is always up to date and error-free, we ask our customers and Users to inform us as soon as possible of any changes and corrections to their personal data.
- DATA RETENTION PERIOD:
CCPC keeps the personal data collected from its customers for a limited and proportional period. The data collected for the purpose of managing the relationship between the User and CCPC (name, surname, postal address, e-mail address, etc.) will be kept for the duration of the contractual relationship and as long as the User does not request their deletion. Once the contractual relationship is concluded or requested by the User, the data will be deleted.
Once deleted, the User’s identification data will be kept by adopting technical and organisational measures that prevent their processing, except for the hypothetical requirement to make them available to the Judges and Courts, the Public Prosecutor’s Office or the competent Public Administrations for the periods indicated below: 6 years for accounting books, invoices, etc. (art. 30 of the Commercial Code). (art. 30 Commercial Code); 5 years for personal actions without special time limit (art. 1964 Civil Code); 10 years for actions derived from Law 10/2010, of 28 April, on the Prevention of Money Laundering and Financing of Terrorism (art. 25); and 4 years with regard to tax obligations (arts. 66 et seq. General Tax Law). Once the upper of these periods has elapsed, the data shall be definitively deleted.
- EXERCISE OF RIGHTS:
To exercise the ARSULIPO Rights of access, rectification, deletion, limitation of processing, portability or opposition, you should contact Ms. RAQUEL MARÍA MILLÁN SONK, data controller, by e-mail info@mardenubesccs.com or by post to the address Cno. Lomo Oreja 6, C.P. 38615, Vilaflor, province of Santa Cruz de Tenerife. However, other means may be used to recognise the identity of the client exercising any of the aforementioned rights and to accredit, in an irrefutable manner, its sending and receipt.
- CONSENT:
The User gives his/her consent so that CCPC can make use of his/her personal data in order to provide a correct fulfilment of the contracted services.
The completion of the form included in the web site or the sending of e-mails or other communications to CCPC, implies the express consent of the User to the inclusion of his/her personal data in the aforementioned processing system.
At the time of requesting this information, the client or User will be informed of the recipient of the information, of the purpose for which the data is collected, of the identity and address of the person responsible for the data on this website and of the User’s right to exercise his/her ARSULIPO rights.
- TRANSFER TO THIRD PARTIES:
CCPC does not transfer data of a personal nature without the express consent of the owners, which must be granted on each occasion, being only transferred for the purpose expressed in each case and always with the consent of the User or client.
- CONFIDENTIALITY AND PROFESSIONAL SECRECY:
The data collected in all private communications between CCPC and the clients or Users will be treated with absolute confidentiality, CCPC committing itself to the obligation of secrecy of personal data, to its duty to keep them and to adopt all the necessary measures to avoid their alteration, loss and unauthorised processing or access, in accordance with the provisions of the regulations in force.
In addition, information of any kind that the parties exchange between themselves, that which they agree to be of this nature, or that which simply concerns the content of such information, shall also be considered confidential. The display of data on the Internet does not authorise the use of such data indiscriminately, except with the express consent of the owner for each occasion.
We recommend that the customer does not provide any third party with his identification or confidential information to third parties.
- MODIFICATIONS TO THE SECURITY AND DATA PROTECTION POLICY:
The present Privacy and Data Protection Policy is established as on October 11th 2022, taking effect from that date.
CCPCPC reserves the right to modify its Privacy and Data Protection Policy in order to adapt it to new legislative or jurisprudential developments, or due to strategic corporate decisions, and undertakes to publish the aforementioned changes on this website.
